Welcome to Cre8ables.com (“Cre8ables,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, design tools, digital assets, subscriptions, marketplace, and print-on-demand services (collectively, the “Platform”).
By accessing or using Cre8ables, you agree to these Terms. If you do not agree, do not use the Platform.
1. What Cre8ables Is
Cre8ables is a creative platform offering customizable design tools, inclusive characters and clipart, a user marketplace, subscriptions, print-on-demand services, and licensing options for personal, commercial, educational, and business use.
Cre8ables provides tools and infrastructure but does not own or control all user-generated content.
2. Eligibility & Accounts
You must be at least 18 years old to create an account, make purchases, or sell designs.
You are responsible for maintaining the security of your account and for all activity that occurs under your account.
3. Acceptable Use
You agree not to:
- Violate any applicable laws or regulations
- Infringe intellectual property or privacy rights
- Create or sell hateful, discriminatory, or unlawful content
- Upload malicious code or disrupt the Platform
- Misrepresent ownership or licensing rights
Cre8ables may remove content or suspend accounts at its discretion.
4. Intellectual Property & Licensing
Cre8ables assets are owned by or licensed to Cre8ables and are governed by applicable license agreements.
You may not resell, redistribute, or claim ownership of Cre8ables assets as standalone files.
5. User-Generated Content
You retain ownership of content you create or upload.
You grant Cre8ables a worldwide, royalty-free license to host, display, promote, and distribute your content solely for platform operations.
6. Marketplace Transactions
Digital sales are final unless otherwise stated.
Sellers are responsible for listings, taxes, and compliance with applicable laws. Cre8ables is not a party to buyer-seller transactions.
7. Subscriptions
Subscriptions renew automatically unless canceled. Fees are non-refundable unless required by California law.
8. Print-on-Demand
Production and fulfillment may be handled by third-party providers. Final products may vary slightly from previews.
9. Third-Party Services
Cre8ables is not responsible for third-party services, content, or policies.
10. Termination
We may suspend or terminate access to the Platform for violations of these Terms or legal requirements.
11. Disclaimers
The Platform is provided “as is” without warranties of any kind, to the fullest extent permitted by California law.
12. Limitation of Liability
To the maximum extent permitted by California law, Cre8ables’ liability is limited to the amount paid by you in the prior twelve (12) months.
13. Indemnification
You agree to indemnify and hold harmless Cre8ables from any claims, damages, or expenses arising from your use of the Platform or content.
14. Governing Law & Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the state or federal courts located in California.
